Terms and Conditions of ERA Realty Network Pte Ltd’s (“ERA”) My Dream Vacation

1. These Terms and Conditions apply to the My Dream Vacation Lucky Draw Promotion (the “Promotion”), organized by ERA. By registering and taking part in this Promotion, each Participant fully and unconditionally agrees to and accepts these Terms and Conditions.

Qualifying Period

2. The Qualifying Period commences on 12 March 2025 at 00:01 and ends on 31 December 2025 at 23:59.

Eligibility & Registration

3. Persons may participate in the Promotion by:
   1. registering with ERA as an ERA VIP at https://vip.era.com.sg/register during the Qualifying Period; and
   2. registering their participation in the Promotion, which includes accepting these Terms and Conditions;  and
   3. being aged 21 years and above; and
   4. not falling within the Excluded Categories.

(each a “Participant” and collectively “Participants’)

4. Excluded Categories refer to:
   1. directors and employees of ERA and its subsidiaries;
   2. registered real estate salespersons with the Council of Estate Agencies at any point during the Qualifying Period;
   3. any person whose participation in and/or association with Lucky Draw may cause (in the sole and absolute opinion of ERA) ERA and/or the Promotion any disrepute, contempt, scandal, ridicule or cause ERA to be perceived unfavourably; and
   4. any other person or class of persons deemed ineligible or notified by ERA as being ineligible from time to time.

5. ERA reserves the right (in its sole and absolute discretion) to determine the eligibility of any person in relation to the Promotion and ERA may at any time during the Promotion (and whether before, during or after the Promotion), disqualify any person from participating in the Promotion without providing any reason if it determines that such person does not meet the eligibility criteria above.

6. The Participant understands and agrees that, in the event that the Participant indicates that they were referred by an ERA Trusted Adviser, who is a real estate salesperson registered with ERA (the “ERA Salesperson”), when signing up to be an ERA VIP at https://vip.era.com.sg/register during the Qualifying Period, or if they sign up to be an ERA VIP via a link sent by an ERA Salesperson during the Qualifying Period, the ERA Salesperson  will become eligible for the a lucky draw specifically for ERA Salespersons upon reaching the required number of ERA VIP sign-ups.

7. As a condition of entry into the Promotion, each Participant affirms and represents that he/she is above 21 years of age and agrees to be bound in all respects by these Terms and Conditions.

Prizes

8. Each prize consists of a S$1000 travel voucher that can be claimed from a travel agency assigned by ERA (“Prize”)
9. Each Participant can only be eligible for 1 Prize throughout the Promotion.

Lucky Draw Mechanism

10. There are a total of 100 Prizes to be won for the Promotion.

11. Subject to clause 13 below, all Participants will have 1 chance to win a Prize in all of the Lucky Draws subsequent to their registration as a Participant. For example, if a person registers as a Participant on 15 May 2025, they will be entered into the Lucky Draws that will be conducted on 12 June 2025, 17 July 2025, 14 August 2025, 18 September 2025, 16 October 2025, 13 November 2025, 11 December 2025 and 15 January 2026.

12.  Participants may earn additional chances by attending selected events as announced through official ERA communication channels (including emails and SMS) and also invites from ERA salespersons.

13. If a Participant wins a Prize, the Participant will be removed from the remaining Lucky Draws.

14. 10 Prizes will be drawn each month. Unless otherwise notified by ERA, the first draw on 22 April 2025 will be conducted at a live event and telecasted live onto ERA’s Facebook Page, and the subsequent draws will be displayed on a television screen and telecasted live onto ERA’s Facebook Page.   The draws shall be shown via Facebook Live. The Winners will be drawn at random. The Lucky Draws shall be conducted on a computerized programme with a randomization formula. Notwithstanding the aforesaid, ERA reserves the right to conduct the Lucky Draw in-person and/or in any other manner and/or by any other method decided by ERA.

*Please note that the lucky draw will be held online between 14:00 and 15:00. The draw is expected to conclude earlier than 15:00 depending on the number of entries or other factors. The lucky draw will end once all relevant processes are complete, and the exact end time may vary.

15. Unless otherwise notified by ERA, each Lucky Draw shall be conducted while audited by an external scrutineer on the dates set out above at the ERA APAC Centre, which is at 450 Lorong 6 Toa Payoh Singapore 319394, except the draw on 22 April 2025 which will be conducted at Marina Bay Sands. Notwithstanding the foregoing, ERA reserves the right to conduct the draw on such other dates and time as ERA may determine at its sole and absolute discretion at the ERA APAC Centre or at such other venue.

Announcement

16. The results of the individual rounds of the Lucky Draws including Winners’ names and the last 4 digits of their mobile numbers provided in the registration forms will be published on the Promotion Website and ERA’s Facebook Page within 7 days after the determination of the results.

Prizes

17. All Prizes are non-refundable and non-exchangeable. There shall be no refund or exchange for any partially used or unused prize.
     
18. Each Winner is solely responsible for all taxes and surcharges applicable to the Prize won.

19. The Prizes may be subject to additional terms and conditions, including but not limited to the terms and conditions set by the travel agency assigned by ERA at its sole and absolute discretion, and each Participant agrees to comply with all terms and conditions applicable to the Prizes.

20. ERA reserves the right to replace any Prize with an alternative prize if circumstances beyond ERA’s control makes it necessary to do so.

Prize Winner Notification

21. Winners will be contacted via email within 7 days after the determination of the results of each individual round of the Lucky Draw via the email provided by the Participant during registration.

22. Winners for the Lucky Draw shall contact ERA within 30 days of the announcement.

Prize Collection/Redemption
 

23.  Winners for the Lucky Draw shall claim their Prize from ERA within 30 days of the announcement of the respective round of the Lucky Draw for which they were Winners. If any prize is unclaimed or the Winner otherwise does not accept the Prize won by the end of the stipulated period, the Prize shall be forfeited.
24. Winners shall redeem their Prize from the travel agency assigned by ERA within 30 days of receiving their Prize from ERA.

Liability and Indemnification

25. ERA is not an agent of the third-party suppliers supplying the Prizes (or any Prize Alternatives). ERA will not accept any liability, whether contractual, tortious or otherwise, for any Prizes provided by these third-party suppliers. ERA expressly disclaims any warranties express or implied in connection with any prizes to the fullest extent permitted by applicable laws. ERA assumes no responsibility for the acts or omissions of the third-party suppliers. ERA shall not be held liable or responsible for any disputes that Winners may have with any third-party suppliers or any other third parties, regarding the use of the Prize. Any disputes concerning the use of a Prize provided by third-party suppliers must be resolved directly between the Winner and the respective supplier.

26. ERA is not responsible for:
    1. Electronic transmission errors or delays resulting in an inability to participate in the Lucky Draw, claim a Prize or other loss;
    2. Theft or destruction or unauthorized access to or alterations of any entry materials, or for technical hardware, software failures of any kind. Lost or unavailable connections, or delayed computer transmission, whether caused by the ERA, or by any of the equipment; or
    3. Programming associated with or utilised in the Lucky Draw or by any technical or human error which may occur in the processing of submissions which may limit, restrict or prevent a party’s ability to participate in the Lucky Draw or claim a Prize.

     

    Proof of delivery of an entry or email is not proof of receipt by ERA.

     

27. Each Participant agrees to release and hold harmless ERA and its directors, officers, employees, agents and/or representatives from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from: (i) their participation in the Promotion, and/or (ii) their acceptance, possession, use or misuse of any Prize or any portion thereof.
28. Each Participant agrees to indemnify ERA and its directors, officers, employees, agents and/or representatives against any losses, claims, demands, liabilities, costs and expenses for personal injury or death, loss, damage to property, breach of any obligations, warranty or representation, fines and penalties, which may be imposed on or which ERA may suffer or incur or which may be made, instituted or asserted against ERA arising out of or by reason of negligent acts, omission, fraud, wilful misconduct, or a breach of obligations, covenants, representations or warranties by the Participant in connection with this Promotion.
29. All Winners whose Prizes have been unclaimed/unredeemed or forfeited hereunder shall not be entitled to any payment or compensation.

Participation and Personal Data

30. By accepting the Prize, the Winner agrees to the collection and public disclosure of his name and image recordings for publicity or commercial purposes in relation to the Promotion.
31. The Winner consents to being photographed or recorded by ERA’s authorized photographers and videographers and consents to ERA’s use of such images, films or recordings for creating marketing and publicity materials for public transmission.
32. Participation in the Promotion requires the processing of the Participant’s personal data including name, date of birth, NRIC/Passport number, nationality, gender, email address, personal mobile number, bank account details (for relevant winners) and residential address. ERA may use Participants’ personal data for the purposes of administering the Promotion and/or arranging for the redemption of the Prize.  
33. The Participant consents to ERA transferring the Personal Data to ERA’s salesperson(s) and/or agent(s) for the purpose of providing Marketing Materials to the Participant. ERA will not disclose the Personal Data to any other third parties for marketing by such third parties without the Participant’s consent.
34. The Participant may require ERA and/or its salespersons not to use the Personal Data for direct marketing purposes, and in such an event, the Participant will cease to receive the Marketing Materials within thirty (30) days after receipt of his/her request to opt out.

Other Terms and Conditions

35. The Terms and Conditions of this Promotion may be revised from time to time at ERA’s sole discretion without prior notice. In the event of any discrepancy between these Terms and Conditions and any other marketing, promotional, advertising or other materials, these Terms and Conditions shall prevail.
36. ERA’s decision on all matters relating to the Promotion shall be final, conclusive and binding. No appeal will be allowed.
37. ERA reserves the right to disqualify any Participant who has submitted an incomplete entry and/or is found at any time (whether before, or after the receipt of any Prize) to be in breach of any of the Terms and Conditions set out herein and/or in breach of any of the terms and conditions in any agreement with ERA. All Prizes awarded to the aforesaid Participant shall be forfeited and returned to ERA promptly.
38. If any provision of these Terms and Conditions are found to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable. If modification is not possible, the provision shall be deemed severed, and the remaining provisions shall remain in full force and effect.
39. The Promotion and these Terms and Conditions shall be governed by the laws of the Republic of Singapore and all Participants are deemed to have agreed to submit to the exclusive jurisdiction of the Singapore courts.
40. These Terms and Conditions are not intended to confer any rights to any third party under the Contracts (Rights of Third Parties) Act (Cap. 53B) to enforce any provision of these Terms and Conditions, and the operation of the said act is hereby excluded.
